Data subjects and personal data

All natural persons whose personal data is used by the controller responsible for the processing are data subjects. Personal data means any individual information concerning the personal or material circumstances of an identified or identifiable natural person (the data subject) such as their name, address, email address, IP address and so on.

 

Controller

The controller is any natural or legal person, which, alone or together with others, has the authority to determine the purposes of and means for the processing of personal data (e.g. names, email addresses etc.).

 

Extent of personal data processing

Our processing of your personal data as a user of this website is limited to the data that is necessary for the provision of a functioning website on the internet as well as the provision of our contents and services.

 

Lawful processing

We may only collect and process such personal data if we do so lawfully. A legal basis for this may be, for example, your permission to do so, although a legal requirement may also permit the processing of your personal data.

If we have obtained your consent to process your personal data, Art. 6(1a) of the General Data Protection Regulation (GDPR) serves as the legal basis. At all times, you have the right to ask us for details regarding the personal data we process, and particularly for details of the processing purposes, the legal basis as well as the origins and recipients of your personal details. We must provide this information for free.

Your other rights include the right to have your personal data corrected, the right to erasure, the right to restrict the processing of your data, the right to data portability, the right to object to the processing of your data and the right to withdraw your consent to the processing of your personal data.  Such a withdrawal of consent does not affect the lawfulness of the processing of your personal data until the withdrawal of your consent.

 

You also have the right to file a complaint to the supervisory body with regard to the personal data we process at any time.

5. Data security

Within the scope of your website visit, we use the common SSL or TLS method in combination with the respectively highest encryption level supported by your browser. You can see whether an individual page of our website is transmitted encrypted by the closed key or lock symbol in the status bar of your browser.

 

We also use other suitable technical and organisational security measures to protect your data against unintentional or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties. We are constantly updating our security measures in line with the latest technical developments.

 

 

6. Analysis tools and advertising

Matomo

This website uses the open-source web analysis service Matomo. Matomo uses technologies that make it possible to recognize the user across multiple pages with the aim of analyzing the user patterns (e.g. cookies or device fingerprinting). The information recorded by Matomo about the use of this website will be stored on our server. Prior to archiving, the IP address will first be anonymized.

 

Through Matomo, we are able to collect and analyze data on the use of our website-by-website visitors. This enables us to find out, for instance, when which page views occurred and from which region they came. In addition, we collect various log files (e.g. IP address, referrer, browser, and operating system used) and can measure whether our website visitors perform certain actions (e.g. clicks, purchases, etc.).

 

The use of this analysis tool is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the analysis of user patterns, in order to optimize the operator’s web offerings and advertising. If appropriate consent has been obtained, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25 (1) TTDSG, insofar the consent includes the storage of cookies or the access to information in the user’s end device (e.g., device fingerprinting) within the meaning of the TTDSG. This consent can be revoked at any time.

 

IP anonymization

For analysis with Matomo we use IP anonymization. Your IP address is shortened before the analysis, so that it is no longer clearly assignable to you.

We have concluded a data processing agreement (DPA) with the above-mentioned provider. This is a contract mandated by data privacy laws that guarantees that they process personal data of our website visitors only based on our instructions and in compliance with the GDPR.

7. Newsletter

Our Newsletter contains information about our activities. We only send newsletters on the basis of your consent (Art. 6.(1a) GDPR) or a public mandate.

 

The contact data for the newsletter is managed by the company "The Rocket Science Group LLC d/b/a MailChimp, (675 Ponce De Leon Ave NE, Suite 5000, Atlanta, Georgia 30308 USA, privacy@mailchimp.com) in short «Mailchimp», where this data is processed. Mailchimp is registered on the «US Privacy Shield» list, which is an agreement between the European Union (EU) and the USA to ensure compliance with European data protection standards in the USA.

 

Registration for our newsletter follows a so-called double opt-in procedure. This means that after registration you will receive an email asking you to confirm your registration. This confirmation is necessary so that no one can register with other people's email addresses. The registrations for the newsletter are logged in order to be able to prove the registration process in accordance with the legal requirements. This includes the storage of the registration and confirmation time, as well as the IP address.

 

With the help of MailChimp, we can analyse our newsletter campaigns. When you open an email sent with MailChimp, a file contained in the email (known as a web beacon) connects to MailChimp's servers in the USA. This makes it possible to determine whether a newsletter message has been opened and which links, if any, have been clicked on. In addition, technical information is recorded (e.g. time of retrieval, IP address, browser type and operating system). This information cannot be assigned to the respective newsletter recipient. It is used exclusively for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

 

If you do not want any analysis by MailChimp, you must unsubscribe from the newsletter.

You can revoke this consent at any time by either sending us an email (newsletter@led.li) or by cancelling it via the link at the end of the newsletter.

 

The legality of the data processing operations already carried out remains unaffected by the revocation. The data you provide for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from the servers of MailChimp after you unsubscribe from the newsletter. Data stored by us for other purposes remains unaffected by this.
